Duncan Forbes, 5th of Culloden was born on 10 November 1685 at Culloden, Inverness-shire, Scotland.2 He was the son of Duncan Forbes, 3rd of Culloden and Marie Innes.2 He married Mary Rose, daughter of Hugh Rose, 15th of Kilravock and Margaret Campbell, on 21 October 1708.1 He died on 10 December 1747 at age 62.1
He held the office of Lord Advocate between 1725 and 1737.1 He held the office of Lord President of the Court of Session between 1737 and 1747.1
